In a rare case of a class action brought against a Government entity for California Labor Code violations for failure to reimburse necessary school supplies and expenses under Labor Code section 2802 as well as a breach of written employment contract, on September 22, 2015, Judge John M. Pacheco of the San Bernardino Superior Court Granted Plaintiff Dora Alcaraz’s motion for final approval of a class action settlement. Dora Alcaraz is represented by Richard E. Quintilone II Esq. of Quintilone & Associates, a leading wage & hour class action firm in the State of California.
The court held that the settlement met all the criteria for final approval and that the notice provided to the class by ILYM Group Inc. was sufficient. There were no objections to the settlement. The Settlement Class involved employees in the Pre-School Services Department as either a Preschool Teacher or Preschool Teacher Aide in California at any time during the class period from September 29, 2006 to March 26, 2015.
As a claims made settlement, the class members were required to submit a claim for a share in the $1,350,000 settlement. More than half of those eligible participated.
